Thank goodness Hurricane Ernesto was a dud; Floridians deserve a break from hurricanes and the rest of us are certainly not starved for hurricane coverage. As this storm's demise became obvious the cable news teams must have scrambled for alternative stories and maybe this prompted CNBC to air an interview with the CEO of a new company called SpiralFrog this past Tuesday. I didn't pay much attention at first, but since part of my job at ICMediaDirect.com entails staying on the lookout for new avenues of interactive advertising and SpiralFrog intends to deliver advertising through where none exists now, I took special notice.

SpiralFrog has an interesting plan and one that's generating interest as advertising dollars continues to migrate towards the Internet. This web-based company will let advertising fees essentially pay the freight of free music downloads for end users. SpiralFrog just signed an agreement with the world's largest music company, Universal Music Group, for access to their whole catalogue, an impressive feat for this new company. Should Apple, with their charged iTunes music, be threatened by these guys?

During this interview Robin Kent, the company's CEO, said he intends on fufilling the online advertising dream - to "monetize the unmonetizable", a phrase he used more than once. I admire his ambition, but this task may prove easier said than done. Low-cost and free options available to end-users of the Internet must certainly frustrate big online media companies. The Internet's experience shows that time and again when given the choice between free and paid content, end-users choose the free option. Is SpiralFrog's offering, then, too good to be true? I mean, what's an advertisement or two for free music, right? Additionally, these downloads will be 100% legal and free of unwanted adware and spyware. Remember, ads don't keep us from watching "24" or "Desperate Housewives".

This may sound terrific, but here are the challenges: 1) these downloads will not be iPod compatible because they will be of the Windows Media Audio (WMA) variety and SpiralFrog users will not be able to make copies of their music. 2) Downloaders will have to sit through monthly bouts of advertising for their music. 3) Mr. Kent described his target audience as the young Internet-savvy crowd that is already not interested in iTunes (thus, SpiralFrog does not pose a direct threat to iTunes success); but being savvy is not a coincidental condition and these elusive targets may not care to sit through mandatory advertising, either. If they can already get free music illegally and without consequence, they might not be lining up to listen to ads.

It would be wise for us in Internet advertising to keep tabs on SpiralFrog's progress because they will be attempting to harness revenue from the huge inventory of free and legal music downloads. The question is will the considerable inducements to use SpiralFrog outweigh the disinclinations not to? Runaway success could mean that Apple would have to change their own successful format, whereas mild success might only serve to encourage challengers to Apple's kingly share in the downloadable music space, possibly Microsoft. And then there's the real possibility that SpiralFrog will be a study in frustration for having gone after a user segment that's already satisfied with illegal downloads. It will be interesting to watch.

But one can't be too hard on the good music executives. It's hard for anyone to think too clearly during and after a three martini lunch. Let's cut the guys some slack here. The gals too if any of them were big shot music execs at the time.

Probably there weren't big shot lady music executives around as the gals would have realized much sooner that it would be much easier to make the thieving rascals who were stealing all of the good music stuff customers in a different Internet way rather than try to scare them into becoming deaf with frequent threats and letters from expensive lawyers.

But anyhow, the music industry folks finally did realize that the Internet was not going to be a fad after all and that never in the history of this world has there been a better way to distribute a product, especially a product that could be digitilized like music, and distributed worldwide over the Internet at so little cost.

Hey, there's money to be made if the music goes through the proper Internet distibution channels. Their channels. Those shopping mall stores cost too much to operate anyway.

So what if it took the music industry guys until 2005 to fall into love with the Internet. Now they are in a firm loving embrace and are happy to have zillions of folks from all over the world paying them a little bit every time they download a song or two.

After all when you multiply any little old number times a zillion the total surely does add up fast.

There are still plently of folks who like to download free music but the paid sites are a lot more convienant to use and there is a lot less chance of sucking in some malware, syyware, or some really nasty computer virus during your download. The sound quality will be much better at most of the legal download sites as well, which is important to music lovers, so the pay for downloading model seems to be sound.

The future of music distribution, artists websites, movie distribution, software distribution, in fact anything that can be digitialized and downloaded to your compuer no matter where in the world you are located, looks to be bright.

People everywhere love their music and the Internet is just a dandy way to get it to them fast. And now we have Ipods. And MP3 devices, and more zillions of music loving people using them. The music industry mogals should easily be able to afford those fancy expensive lunches for a very long time.

Have you ever tried to download music from the Internet? Where do you go? A logical starting place is to type in "download music" at a major search engine. The search results you would see include a number of well known music services like Apple iTunes, Rhapsody, and Yahoo! Music Unlimited. But a majority of the sponsored links scream to you with messages like "99 Billion Songs", "Free", and "No Download Fees". Sounds pretty enticing? But, is it too good to be true? Read on to find out.

When you click on one of these sponsored links you will be taken to a very professional looking site. For this article we'll call the site MusicScamSite.com. The home page again reiterates the messages "Free!", "No monthly fees" and "No per song fees", along with promises of a very large library of songs; 12 million, 99 million or even 99 billion. Just "click here to download".

If you decide to proceed, you are asked to enter your name and email address. If there is a privacy policy or terms of service link available at this point, it often provides some interesting reading. Common provisions include: "MusicScamSite.com is a direct marketer that delivers email messages to its subscribers. All information voluntarily provided to MusicScamSite.com by a registrant may be used to support our marketing partner's data services business." This is the first red flag that this web site may not be what it first appears to be.

If you still decide to proceed further and volunteer your email address, you get another surprise on the next page: This free service requires a $34.95 membership fee for unlimited access. Or you can pay $1.37 per month for 2 years access. Hmm, this is an odd definition of free. But it's not unusual that "free" things often have a small fee associated with them, and $35 is a reasonable price to pay for unlimited access to music. And since you are paying a fee, it must be a legitimate service, right?

You have already given up your sacred email address, so what's another screen with your address and credit card information? You proceed. After successfully completing the transaction you finally gain access to the secret member's area. Here you will find links to software that you need to install on your computer in order to start downloading music. Commonly linked to software include LimeWire, and various versions of Kaaza and Gnutella.

But wait a minute! Are these not all freeware, peer-to-peer type applications? Indeed they are. And all the music files that you thought were provided by MusicScamSite.com are in actuality coming from your peers - users of the same peer-to-peer software.

Now you start to feel scammed. Isn't this illegal? While most people would probably agree that it is unethical to charge money for something that is otherwise available for free, it is probably not illegal. And besides, when you read the fine print of the terms of service you will notice that "the fee assessed by MusicScamSite.com entitles you to access the location, evaluation, and or recommendation of software products available from the web site and for the installation and technical support provided. All software recommendations refer to software that is available without charge to individuals at large for specific purposes." In other words, you are not paying for the software, just their recommendation of the software and their technical support.

But isn't it illegal to download music from peer-to-peer networks? Again the fine print absolves MusicScamSite.com from any responsibility: "Original works of authorship, including literary, dramatic, musical, artistic, and certain intellectual compositions are protected by copyright law. Purchasing a membership in MusicScamSite.com does not give you license to download or upload copyright material. MusicScamSite.com implores you to respect copyright laws and share responsibly."

In summary, you have just parted with your email address and good money, and in return you have received free software and access to a publicly available P2P network. If you use this software to download any copyrighted music you will be breaking the law and may find yourself sued by the RIAA. None of the money that you paid to MusicScamSite.com will ever make its way to the music artists. To put it bluntly: you've been scammed.

How can you avoid being scammed?

1. On the Internet in general, keep in mind the old adage "If it sounds too good to be true..." Music artists and record companies like to make a living, so it is very unlikely that they will wholesale give away all their music for free or for a one time fee.

2. Do some further research before you part with your money. Type in the name of the site that you are considering; combine the name with words like "scam", "fraud", "refund". 3. Check out the site using a legitimate review site like McAfee SiteAdvisor.

4. Call the technical support number listed on the site. Can you get through at all? Since technical support is what you are really paying for, you should check it out before you buy.

5. Ensure that you have up-to-date anti-virus and adware scan software installed. This will not prevent you from being scammed, but it will protect you from some of the unwanted extra gifts that are often installed with the downloaded software from these scam web sites.

But others see no problem with free downloads, some even completely embrace them. In fact, many cite the exorbitant costs of records as justification alone for free downloads. This type of download and the users that either embrace or condemn them are a hotly contested topic; it's an argument not likely to end anytime soon.

For the musician, however, downloads are an absolute breakthrough technology, allowing, for the first time in history, for a musician to develop a following without ever leaving his or her house! In 2000, the first major opponent, since P2P had become really popular, appeared. Superstar metal/hard rock band, Metallica discovered that a demo of theirs "I Disappear" was floating around the internet, before it was officially released. Metallica was tipped off when radio stations accidentally started playing the song, assuming it had already been released. Metallica filed a law suit, and soon after them, so did Dr. Dre.

Rockers, rappers, and record labels complained that they were losing profits. They built their argument around the premise that peer to peer music-sharing not only hurt sales, but violated copyright laws. Advocates of the free mp3 music download intended to keep it that way and claimed they were forced to download mp3s because the artists and record labels were no longer producing quality music that was worthy of being purchased.

After much fighting, the United States Government had to step in to settle the dispute. The Government shut down P2P music sharing and criminalized it with heavy fines and possible jail-time; this was a huge blow to advocates of free music, but, instead of lying down and accepting the sentence, hundreds of underground file-sharing sites sprung up to fight the government and big business, under the premise that the government couldn't catch them all. First I must say that I consider myself to be an Expert in the area of providing Hypnotic (and Magical) Entertainment. I say this not out of a sense of ego, but because although I am not an entertainer myself; Providing, Producing & Directing Hypnotic & Magical Entertainment has been my Exclusive Business Focus for nearly 15 years now. I am also a certified professional hypnotist, but I would NEVER profess to be a "Hypnotic Entertainer"!

I have worked with a wide variety of Stage Hypnotists over the years, and in a variety of capacities. After a few years I came to one conclusion... All Hypnotists are certainly not created equally...neither in the talent that they possess or the methods in which they do business. Oh yes, many of them can charm the pants right off of you... remember that persuasion is part of what they do!

The entertainment provided by venue is certainly a reflection of the knowledge of the individuals whose job it is to actually secure & book the talent. Unfortunately, over the years I have found that many people in these jobs do not know what they need to know when it comes to booking Stage Hypnotists. Most individuals in those positions simply know that having a Hypnotist is a crowd pleaser. They are right in their thinking on the one hand... having a Stage Hypnotist perform a few times each day during the run of an event is most certainly a drawing act. Many attendees return repeatedly to open to the public events just to see the Hypnotist. I can state this from personal experience, since about 20 years ago, I myself was what I now call in the business... a "hypno-junkie". These are the people who are so fascinated by Hypnosis Shows that they just can't seem to get enough of them. So began my business career & involvement in providing this type of entertainment, although I used to "pretend" to hypnotize my friends in the dressing room of my Home Ec Class in Junior High School.

I wish to state that MANY of the individuals who sell themselves as "Hypnotic Entertainers" are simply people who have either studied hypnosis in one way or another, and/or received certification of some type... many by attendance at a weekend seminar. Know that Hypnosis is NOT governed or regulated on a National level, and VERY FEW states regulate it in any way whatsoever. Obtaining Certifications and/or Registrations with local or national Hypnosis organizations is VERY easily achieved... therefore virtually ANYONE can call themselves a Hypnotist, with or without any type of study, knowledge or "certification". Please understand that I am absolutely not knocking anyone who obtains certification in any hypnotic organization... I am simply stating that there is MUCH MORE TO IT THAN HOLDING A CERTIFICATION OR REGISTRATION.

Just drink that in for a minute. I could train & prep YOU (in a very short time period) to get on a stage and perform a Hypnosis Show. Would you consider yourself qualified as a Stage Hypnotist / Performer... I THINK NOT! But that is exactly much of what is on stages across the country today in my Industry! That is a pretty scary thought isn't it... since we are dealing with people's psyche in these shows?

Having some virtually worthless Hypnotic "certification" certainly does not qualify an individual to be knowledgeable enough to actually handle an abreaction (a negative emotional response) should it occur during a performance (which does happen at times).

Most certainly, having some "certification" DOES NOT MAKE THEM AN ENTERTAINER... and I am here to say THAT is one HUGE difference that buyers of talent need to look at ! Is this individual that you are about to hire, an "Entertainer" first and foremost, who simply uses Hypnosis as his tool to entertain with? OR Is this individual you are about to hire a person with some easily obtained "paper" credentials who is TRYING TO BE AN ENTERTAINER?

Some buyers of talent are very hung up on the Hypnotist having "paper credentials", when most of these buyers don't realize how worthless it really is. Point in fact is that having that "paper" is absolutely NO INDICATION of what you are actually buying in the way of suitable entertainment for your event & attendees!

In my personal business of delivering Hypnotic Entertainment, I am affiliated with only one Featured Performer. I frequently look for QUALITY & QUALIFIED Stage Hypnotists whose services I can use in cases such as double bookings for my own Featured Show. I rarely find those individuals, since the Quality Acts & Performers are generally as booked up as we are. I am very frequently approached by other Hypnotists who want me to book them... so I acquire their promotional materials... I go see their "shows"... I VIEW THEIR WEBSITES... and I repeatedly turn them down! I will not attach my name to "entertainment" such as that which is delivered by most of these hypnotic performers.

Look for the "Entertainer" qualities first. Is he/she charismatic? What types of High Venue & Events have they performed for or do they spend most of their time in a Hypno THERAPY practice? Do they have many years of studying the mind and Hypnosis behind them, or are they what I call a "weekend wonder"? How long have they actually been performing... most entertainers started out as a child in some way or other. Is their show active? Do they musically choreograph their shows? Are they "clinical" in their appearance & delivery? Is their "show" merely a "demonstration" of Hypnosis instead of an entertaining performance? Are they trying to sell you by using the fact that they are "certified"?

Very importantly what about the Ethics involved... is the material and routine structure of their show appropriate for your attendees and audiences? I cannot tell you how many times I have seen Stage Hypnotists crossing that line at family style venue. I have often watched them at Fairs, performing skits that were sexual in nature and very inappropriate for family shows. I have watched Stage Hypnotists seriously degrade and humiliate their volunteers... all in the name of "fun". I have watched Hypnotists elicit negative emotions such as anger & the like from their subjects in shows. Folks, our subconscious minds take in & remember EVERY sensatory experience in our lives... therefore it may be long after a performance when a volunteer has a negative experience due to their involvement with a Hypnotist Show.

As artists & entertainers I believe that we have a great responsibility to provide & deliver positive & appropriate performance, especially in the family environments. Factually speaking, I couldn't tell you how many times, sometimes months or years after a show, I have had a volunteer tell me how their life changed for the better in some way as a direct result of their having been in one of our shows. THAT is what should be the "norm" for Stage Hypnotist acts. We simply bring their inner child out to play for a while in a very responsible & entertaining way... AND we leave them feeling empowered by their experience with the shows I offer. I simply wish that all Stage Hypnotists took this as seriously as I do... and I wish that all buyers of talent knew what to look for!

Our minds are simply incredible and very powerful. Stage Hypnosis is a terrific form of entertainment... when used properly, and by a real "entertainer"!

There are plenty of Stage Hypnotists who sell themselves "cheaply" and unfortunately this is often a primary consideration & criteria of buyers of talent. I am simply here to say that this is not an area of performance where you want to cut costs - Spend the money and hire a Pro or please dont hire it at all! After monitoring numerous related factors for well over a decade I urge you to ask the hard questions when contracting this type of act for your event.

NOW ONTO THE AREA OF HOW THIS IS ALL RELATED TO WEBSITES AND ELECTRONIC MEDIA.

The fact that I am in the Magic Business as well, I say to you.... PLEASE don't blindly believe what you see and or hear in the promo materials & websites of some of these performers. Illusion is as much a part of my business life as is the Hypnotic portion. Know that anything can be made to "appear" to be something it is not... and that is the key... "appear to be"!

I have personally had individuals whom I mentored in Hypnotic & Magical Entertainment list MY business bookings as THEIR CLIENTS on their websites... some of these individuals actually even list some of my clients / events as theirs when they were actually in jail when I cold called and secured that client / event!

I have documentation whereby ACTUAL NEWSPAPER STORIES THAT INCLUDED MY PHOTOGRAPH IN THE ORIGINAL PUBLICATION HAVE BEEN ALTERED & APPEAR ON THE WEBSITES OF UNETHICAL PERFORMERS WHO HAVE REMOVED MY PHOTO AND REPLACED IT WITH THEIR OWN TO PORTRAY AN "ILLUSION" AND IMAGE OF THEMSELVES THAT IS ANYTHING BUT HONEST...

I have documentation whereby Quotes from Letters written to myself have been altered & appear on the websites of unethical performers who have removed my name and or the name of my company & inserted their own names in it's place to once again PORTRAY AN "ILLUSION" AND IMAGE OF THEMSELVES THAT IS ANYTHING BUT HONEST.

As of the time of this writing and on the website of one of these VERY UNETHICAL HYPNOTIC performers appears a Hypnosis Fact Sheet that I WROTE and had available stage side for many, many years as a literature handout at the performances... once again when viewing his website you would think that it was of course written by himself. I could go on and on about this type of behavior.

My point is that we live in a very electronic age where things can be & are being easily and readily altered and changed to give the receiver / viewer of information an impression that is anything but honest.

DON'T just buy into the illusion of what you see on websites...

DO REQUIRE actual copies and proof of claims made by these "entertainers"...

and

PLEASE DO continue to buy QUALITY entertainers!

Where to get safe and legal downloads for your iPod on the cheap!

iPods are great! What more can I say? If you don't have one yet, you just don't know what you're missing out on. I didn't either.

I actually have the very first, original iPod that was manufactured. I just had to have it. My own personal reasons were that I travel in the car a lot and wanted to listen to my Coast To Coast radio shows that I never get to listen to at home.

Now, I've actually been on a Mac for over 10 years, but the company laptop is of course a PC. I was really anticipating problems with the conversion, what with that entire Mac to PC stuff. To my surprise, all I did was download iTunes for the PC and drag and drop my folders of the shows into iTunes. Then I just hooked up the iPod to the PC and downloaded the shows to the iPod. Was I shocked or what?

After awhile, I got a bit bored with all the shows and wanted some variety. Sure, I could rip my own CD's and transfer those to the iPod, but I also wanted some audio books to listen to on those 7 hour drives. That's when I discovered how cheap it is to legally download everything I could ever want and transfer it to my iPod.

I was also given the new iPod Photo for a birthday gift. At first, I thought it was simply for loading photos. Then, I didn't think I'd watch music videos but I was interested in watching movies in my downtime. I just wasn't sure where to get them and how to do it.

I used the Apple store at first to download some videos but I have to tell you, that decision ate right through my pocketbook. What Apple does is charge you per download and in the end, you're basically paying retail for everything. You have to buy a la carte.

I then read review after review on download services. I had read about people downloading malware and viruses in addition to having extremely slow download speeds, even with a broadband connection. I then ran across a review by Top Service Review that rated the top three iPod download services and I ended up joining the Editors Pick.

What I've gotten with an iPod download service is simply this: I paid a small fee that's good for lifetime, unlimited access! Not monthly, not per download, but forever?I can log in anytime of day or night, 365 days per year and download movies (some that have just hit the theatres), music, videos, television show episodes, audio books, music videos and sporting events. Included in the deal, I also got all the conversion and ripping software to convert the DVD movies and transfer them to my iPod along with tons of video and audio tutorials.

In a nutshell, I've got so much stuff; I can't fit it all in my iPod. It just sits here and waits for its turn.

You really want to be careful about the service you sign up for; many of them claim to have unlimited access and it's not. Others claim fast download speeds but their servers are jam-packed and you'd think you were on dial-up. Others download malicious code onto your computer for their own insane reasons. I personally went with a particular site that I post on my blog because the rating and reviews were all 5 Star. I haven't been sorry to date.

Even if you have an iPod Mini or an iPod nano and can't watch movies and television shows on your iPod, you can still rack up on music, audio books and audio feeds, since they offer well over 95,000,000 media files. Let's put it this way, it's still cheaper than two DVD's. I sure am glad I got the 60GB iPod!

"Justice Konrad von Finckenstein ruled Wednesday that the Canadian Recording Industry Association did not prove there was copyright infringement by 29 so-called music uploaders. Without the names, CRIA can't begin filing lawsuits against the alleged high-volume music traders, identified only as John and Jane Does. It also reaffirms what the Copyright Board of Canada has already ruled -- downloading music in this country is not illegal. Von Finckenstein said that downloading a song or making files available in shared directories, like those on Kazaa, does not constitute copyright infringement under the current Canadian law. "No evidence was presented that the alleged infringers either distributed or authorized the reproduction of sound recordings," he wrote in his 28-page ruling. "They merely placed personal copies into their shared directories which were accessible by other computer users via a P2P service."

With all of the usual cavets about appeals, this decision makes it practically impossible to prosecute file sharers in Canada. von Finkenstein has gone well beyond the idea that downloading is legal in Canada. By expressly mentioning "merely placing personal copies into their shared directories" does not constitute distribution he has blown a huge hole in the arguments which swirled around the whole question of the legality of uploading in Canada.

The Supreme Court of the Netherlands has thrown out an appeal by music industry lobbyists who wanted the popular Kazaa file-sharing software to be ruled illegal.
The victory for Kazaa, which follows similar US rulings in favour of peer-to-peer (P2P) software firms Grokster and Morpheus, is a huge blow to the music industry. It has fought a long battle to close down file-sharing networks and criminalise the software that makes file swapping illegal. The Dutch decision means that the developers of the software cannot be held responsible for how individuals use it.

DivX: developed by DivXNetworks, this is a file that enables fast movie downloads without losing any picture quality - and DivX is also based on the MPEG-4 video file standard that we mentioned above.

Codec: although it sounds mysterious, this is a piece of software that enables file COmpression and DECompression to transfer it across the internet.

MP3: short for "MPEG Audio Layer 3" - from MPEG again. This is for digital audio only, it uses a compression method that means smaller file sizes. You lose some information but most people can't hear the reduction in quality. So it's great for music downloading and playing audio on an MP3 player. But this is only for music, not for movies.

P2P: short for peer to peer. This is one popular method of sharing and downloading millions of movie and music files. Peer-to-peer is a form of computer network that does not rely on a server and client, but each computer is a peer or equal - great for downloading and sharing home video and audio content. Even with compressed files it can take time and sharing the load amongst several computers is a clever way to harness the power of the internet.

So when you've downloaded the files - how do you watch them?

On Windows PCs these files will usually play without a problem on the standard Windows Media Player, particularly if you have the latest version.

For Apple Macs QuickTime is both a file format and a player. Designed by Apple Computers QuickTime has been around a while. You can download the player from the Apple website and you can run it on a windows PC.

Having mentioned Apple it would be difficult not to mention the iPod. But playing movies on iPods and other portable players is another topic entirely!
